This report aims to improve the relevant Framework Act on Qualifications(Hereinafter ‘FAQ’), with the introduction of private qualification provisions given to those person who completed the required course(Hereinafter, “course qualification"). In addition to that, this study also aims to improve advertising provisions which has misled consumer and the structure and contents of FAQ. The contents of the report consists of three chapters. First, it provides background and methods to the introduction of private qualification for the introduction of course qualification. Second, it tried to add more regulations in advertising of private qualification. Third, it provides provisions to improve the structure and contents of FAQ. To effectively conduct this research, literatures and previous studies, including Republic of Korea and other country have been analyzed and experts opinion were utilized.
FAQ does not provides any provisions on course qualification for private qualification through the National Competency Standards (Hereinafter 'NCS'). Since Korea government announced that it would introduce the course qualification, it is necessary to develop relevant provisions with this. This report suggested provisions which should be included in FAQ and items to be researched in the future.
Regarding the advertising of private institutions, false and exaggerated advertisements has been continuously increasing in recent years. These kinds of advertising has been damaged job seekers. In particular, some institutions placed ad which was false and exaggerating saying that qualifications or certificates they provide are pathway to a full employment. The situation making worse of private qualification is that the victims of the false or exaggeration advertising are mostly belong to lower level of education or unskilled class. Therefore, this report suggested to employ more detailed provisions and to strengthen the punishment of violation of FAQ to promote fair competition among the advertisers and to give consumer more transparent and unbiased messages for their reasonable choice. Also, we recommended to have a continued education for the private qualification administrator in advertising.
In respect of the structure and contents of FAQ, the Act has been revised in response to the demands of the time. This report recommended to include some provisions in FAQ: relationship with other laws to establish the FAQ as the basic Act in qualification; separation of private qualification provisions to overcome misunderstanding that FAQ is a private qualification Act; and other provisions to guarantee the governance of FAQ.
